Allegations - "A lawyer for the Tiwi Land Council has denied the signature of a traditional owner on the Tiwi Islands was forged on a document which formed part (of) a 99-year lease agreement" Result - Justice Stephen Southwood found there was not enough evidence to substantiate claims of bribes and forgery continued | The disparity in bargaining power between the Federal Government and the Tiwi Islanders is obvious on many levels, especially in the present hostile environment, but is simply ignored by Justice Stephen Southwood So too, is the indecent haste to force these 'land deals' through by a Federal government with a history of neglect and overt racism Ed: Disclosure of interest - Justice Stephen Southwood sent me to Berrimah prison for a month earlier this year (anti-racism action) - I refused to apologise to the Members of Parliament we entertained and educated with our protest in 2002 - despite pleas from the Justice - [Most in Berrimah prison are Aboriginal - it's one of two black POW camps in the Northern Territory] |

A traditional owner from the Tiwi Islands is applying for an injunction to be put on the signing of a 99-year lease over the community of Nguiu. Adam Kerinauia is alleging the consent which was given to a Memorandum of Understanding between the Commonwealth and traditional owners was "dishonestly" obtained. Mr Kerinauia says his signature appears on the agreement but he did not sign it. The Tiwi Land Council's lawyer today argued there are many "A Kerinauia"s on the islands. In referring to an affidavit by Jeffrey Simons, the court today heard his signature also appears on the document but he denies signing it. The Land Council's lawyer told the court there was no explanation as to why Mr Simons' signature was on that document. Source Land permit changes impacts Tiwi Island decision Posted August 7, 2007 16:21:00 A Northern Territory Supreme Court decision on whether to grant an injunction to stop a 99-year-lease on the Tiwi Islands community of Nguiu has been delayed. Traditional owner Adam Kerinauia is seeking an injunction because he says his signature was fraudulently added to a list of people who support the lease. A ruling was expected today but Justice Stephen Southwood has adjourned the matter to hear more on how the Commonwealth changes to the Aboriginal land permit system will affect the community. ___________________________________ Quote this article on your site | Views: 249 | Print | E-mail
